General Terms and Conditions of Sale (as of 11/02/2026)

ARTICLE 1. Designation

In what follows, the seller refers to GAMES FACTORY* and the buyer refers to the seller's customers, whether professional or private.

ARTICLE 2. Scope – Communication – Acceptance

The general terms and conditions of sale (GTC) set forth in this document apply to all buyers and cover all services and products of the seller, with the exception of those directly provided by partner service providers of events organized by GAMES FACTORY, including the fuel company(ies) and the tire manufacturer(s). Placing an order with the seller implies the buyer's unreserved acceptance of the GTC. A buyer may not invoke the absence of a reference to the GTC on a seller's document to consider that the seller waives any of the conditions stated therein.

ARTICLE 3. Special Conditions

Special conditions granted to the buyer are applicable only if they have been the subject of a prior written agreement from the seller. Only the points explicitly mentioned in this prior agreement constitute a derogation from the General Terms and Conditions of Sale, which otherwise apply in full.

ARTICLE 4. Definition of services offered

The services and products offered are described as precisely and explicitly as possible. It is the buyer's responsibility to request further information if deemed necessary. The services offered adhere to the principles defined by the specific regulations of the events, as generally presented on the website www.gamesfactory.fr. The seller reserves the right to remove or modify any service or item at any time without prior notice.

ARTICLE 5. Price

Unless otherwise specified in writing, prices are those in effect on the date of the order. These prices are subject to change without notice. In accordance with applicable law, prices may be revised and products invoiced according to their value on the date of shipment or service.

ARTICLE 6. Payment

Unless explicitly agreed otherwise in writing by the seller, payment is due in full, net, and without discount, regardless of the delivery method. Payment terms cannot be modified, even in the event of a dispute, without the seller's written consent. If payment is made by check, its clearance on the agreed due date constitutes payment. Payments by credit card are processed by entering the buyer's card number, and the buyer's account is debited in their currency at the exchange rate in effect at their bank. The seller is credited in Euros. Interest, as stipulated by law, is immediately payable by the seller in the event of late payment. In the event of late payment or failure to pay the due date, without prior written agreement, the seller reserves the right to demand full payment of all sums owed by the customer, including for other orders or for other reasons, after sending a formal notice by registered letter with acknowledgment of receipt that remains unpaid after a period of 15 days. The costs of recovering the sums owed are to be borne by the buyer.

ARTICLE 7. Delivery

The service and/or delivery can only take place if the buyer is up-to-date with their obligations to the seller. The seller undertakes to provide the service in accordance with the order, while reserving the right to modify certain services if the organization of the events so requires. A modification of the services cannot give rise to a claim for compensation of any kind, nor to a cancellation of the order.

ARTICLE 8. Right of withdrawal

The buyer has the option (within 24 hours or more before the reservation) to cancel the order. They will be entitled to a credit note of the same value within 30 days of exercising their right of withdrawal. After this period (less than 24 hours before booking) The buyer will no longer be eligible for a credit note. In accordance with the French Data Protection Act of 6 January 1978, the buyer has the right to access and rectify their personal data. Bank card details are only kept for the duration of the order processing.

ARTICLE 9. Liability

GAMES FACTORY cannot be held liable for any improper or abnormal use of the product, nor in cases where the buyer fails to comply with the rules established by the seller regarding the services offered. In accordance with legal provisions, competition products and services, given their intended use, are not covered by any warranty or compensation.

ARTICLE 10. Force majeure

The seller shall not be liable for any delay in performance or failure to perform its obligations due to unforeseen circumstances or events beyond its control, including natural events, acts or actions of governmental or public authorities, labor disputes, fires, or inability to obtain supplies.

ARTICLE 11. Divisibility

Should any of these terms and conditions be deemed invalid, illegal or unenforceable, this shall not in any way affect the validity, legality or enforceability of the other provisions.

ARTICLE 12. Disputes – Applicable Law – Jurisdiction

In the event of a dispute, the competent court is the Commercial Court of Paris, to hear all disputes that may arise from this agreement. In the event of a dispute with a foreign individual or legal entity, French law shall apply.

ARTICLE 13. Use and conditions of the promotional code

ARTICLE 14. Data Protection

As part of its business, the seller collects and processes personal data concerning its customers, in accordance with applicable regulations, in particular those relating to General Regulation on Data Protection (GDPR) and the French Data Protection Act.

Data collected
The data that may be collected includes, in particular: name, surname, email address, telephone number, as well as any information entered via the site's forms (reservation, contact, registration, participation in a competition, etc.).

Purposes of treatment
Personal data is collected for the following purposes:

reservation and order management,
customer relationship management,
sending commercial offers and promotional information (subject to customer consent),
improvement of services and user experience.

Legal basis
Data processing is based on:

the execution of a contract (reservation, purchase),
customer consent (commercial prospecting),
the legitimate interest of society (improvement of services, security).

Data recipients
Personal data is intended exclusively for the company and, where applicable, its technical service providers (hosting, marketing tools), solely within the scope of their assigned tasks. No personal data is sold or transferred to third parties.

Shelf life
The data is kept for a period strictly necessary for the purposes for which it was collected, and in accordance with applicable legal obligations.

User rights
In accordance with applicable regulations, the customer has the following rights:

right of access, rectification and erasure of data,
right to restriction of processing,
right to object to the processing of data,
right to data portability,
right to withdraw consent at any time.

The customer also has the right to lodge a complaint with the CNIL.

Telephone canvassing

Data security
The company implements all appropriate technical and organizational measures to ensure the security and confidentiality of personal data and to prevent its loss, alteration or unauthorized access.
